[Red5] Recording FLV (audio only) even if there's not audio

I have a simple demo whereby I'm recording audio only through Red5 stream.
I find that it only records when there's actual sound.  I  set
mic.setSilenceLevel(1)  -which, I would think, send data no matter what.

I know I'm missing something, but what is it?  my brain is a touch tired ;)

Any tips/tricks are most welcome ;)
