[Red5] RTMP is patented by Adobe?

I guess nothing has change, if patented its useless for most of the
current uses of RED5.
Did anyone know about this when the RED5 project started or when
developing sites based on Red5?
I still feel that for commercial solutions, the likelihood of there
being a patent increases the risks for a lawsuit. While some may not
see this as a show stopper, in most commercial cases Red5 vs FMS will
win out.
It would be good to actually seek counsel to clear the matter.
